Terms of Service

1. Acceptance of these terms

By creating an account, uploading an image, or generating any output with Oviya Studio, you confirm that you have read and agree to these Terms of Service. If you are using the service on behalf of a business, you confirm that you are authorized to bind that business to these terms. If you do not agree, please do not use the service.

2. Description of the service

Oviya Studio is an AI-powered creative studio. You upload photographs of your product, and the studio generates fashion and product imagery from them, including styled model shots, hero images, and short video, using automated generation systems. Outputs are produced by artificial intelligence and are not photographs of real events.

The service is offered as it stands and is evolving quickly. We may add, change, or remove features, models, and pricing over time. We aim to give reasonable notice of material changes, but we may make changes without advance notice where needed for safety, security, or legal reasons.

3. Your account

You need an account to use the studio. You are responsible for the accuracy of your account details, for keeping your login secure, and for all activity that happens under your account. Tell us promptly at support@oviyastudio.com if you believe your account has been used without your permission. You must be old enough to form a binding contract in your country to use the service.

4. Credits, pricing, and payments

• Credits are prepaid value. The studio runs on credits. Credits represent prepaid value denominated in Indian Rupees (INR), where one credit equals one rupee of value. You spend credits when you generate outputs, and different output types cost different numbers of credits.
• Buying credits. You can top up your balance by purchasing a credit bundle. Some bundles include bonus credits as part of launch pricing. The price and the number of credits granted are shown to you before you confirm any purchase.
• Launch pricing. Introductory and launch pricing is time limited and may change. Any promotional grant or bonus applies only to the purchase it was offered with.
• Non-refundable. Credits are non-refundable and have no cash value. They cannot be transferred, sold, or exchanged for money. The one exception is the fidelity guarantee described below.
• Expiry and changes. We may adjust the credit cost of any output type. We will not retroactively remove credits you have already purchased, though unused credits may be subject to reasonable expiry terms disclosed at purchase.

5. Fidelity guarantee

We stand behind the quality of what the studio produces. If a generated output fails our fidelity check because it does not faithfully preserve your product, you are not charged for it, and any credits spent on that output are returned to your balance. This fidelity guarantee is the sole and exclusive credit remedy for generation quality, and it operates through credit restoration rather than a cash refund.

6. Acceptable use

You agree not to use the studio to create, upload, or distribute content that:

• infringes anyone's intellectual property, publicity, or privacy rights;
• depicts a real person without their consent, or impersonates a real individual;
• is unlawful, hateful, harassing, sexually explicit, or exploits minors in any way;
• is deceptive, fraudulent, or designed to mislead about who created it or what it shows;
• attempts to reverse engineer, overload, probe, or disrupt the service or its systems.

We may suspend or remove content and accounts that break these rules, and we may report serious violations to the appropriate authorities.

7. Your content and the rights you grant

You keep ownership of the images you upload. By uploading, you confirm that you own those images or have all the rights and permissions needed to use them and to let us process them, including the rights to any products, artwork, logos, and people shown in them.

You grant Oviya Studio a limited license to store, process, and transform your uploads for the purpose of operating the service and generating your outputs, and to keep them available to you in your account. We do not use your uploads to train our own foundation models, and we do not sell your content.

You own your outputs. Subject to your payment of the credits used and your compliance with these terms, you own the images and video the studio generates for you and may use them for commercial purposes, including marketing, catalogs, and storefronts.

8. Our intellectual property

The Oviya Studio name, wordmark, interface, software, and underlying systems belong to us and are protected by law. These terms do not give you any right to use our brand or technology except as needed to use the service as intended.

9. AI-generated content

Outputs from Oviya Studio are generated by artificial intelligence. They may carry content provenance signals indicating that they are AI generated. You are responsible for how you use your outputs, including any disclosure that may be required by advertising standards, platform rules, or law in the places you publish them. AI generation can occasionally produce unexpected or inaccurate results, and you should review outputs before using them publicly.

10. Disclaimers and limitation of liability

The service is provided on an as is and as available basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error free, or that any output will meet a specific commercial expectation beyond the fidelity guarantee.

To the maximum extent permitted by law, Oviya Studio and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the service will not exceed the amount you paid to us for credits in the three months before the event giving rise to the claim.

11. Suspension and termination

You may stop using the service and delete your account at any time from within the app. We may suspend or terminate your access if you breach these terms, if required by law, or to protect the service and its users. If we terminate your account without cause, we will make a reasonable effort to let you recover your content first. Credits that are forfeited due to your breach of these terms are non-refundable.

12. Governing law

These terms are governed by the laws of India, and the courts of India will have jurisdiction over any dispute arising from them or from your use of the service.

13. Changes to these terms

We may update these terms as the product and the law evolve. When we make material changes, we will update the version shown here and, where appropriate, notify you in the app or by email. Continuing to use the service after an update means you accept the revised terms.
